After a heated domestic dispute on August 29, 2024, that led to Chigvintsev’s arrest, both parties have filed for restraining orders against one another, each accusing the other of being the aggressor. The couple, who share a 4-year-old son, Matteo, have been estranged since the incident and are due in court on October 21 for a full hearing.

The morning of the dispute, Chigvintsev was preparing breakfast for their son when, according to Garcia, tensions began to rise. Garcia, 40, claims that Chigvintsev, 42, had grown increasingly angry since being cut from Dancing with the Stars, a show where they first met in 2017. She alleges that an argument over how Matteo’s English muffin should be toasted spiraled into a confrontation in which Chigvintsev became verbally aggressive. In response, she threw Matteo’s shoes at him—a decision she admits was a “momentary lapse in judgment” but insists caused no harm.

Chigvintsev’s version of events paints a different picture. In his court filing, he alleges that Garcia escalated the situation, criticizing him for not carrying his weight as a parent. He maintains that he stayed calm throughout the argument, only for Garcia to lose her temper, throwing shoes at him and verbally attacking him. He claims that he took Matteo upstairs in an attempt to deescalate the situation, but Garcia followed, forcing her way into their son’s room and continuing the altercation.

Both parties describe a physical struggle that ensued near Matteo’s room. Garcia alleges that Chigvintsev “tackled” her to the ground outside their son’s bedroom and later forced her onto the floor in their bathroom, where she says she felt suffocated by his hands pressing on her chest. Chigvintsev, however, denies these allegations, stating that he only tried to move her out of Matteo’s room to shield their son from witnessing further conflict.

The situation escalated to the point that Chigvintsev called 911. However, he was ultimately the one arrested, a decision that surprised him, as he did not believe he was the primary aggressor. In his filing, Chigvintsev shared photos of injuries he claims were caused by Garcia during the altercation. Garcia, in turn, pointed to red marks on her chest and arms, which she says were a result of Chigvintsev pinning her down.

Since the incident, Garcia has filed for divorce, officially ending their two-year marriage on September 11. She has also secured a temporary restraining order against Chigvintsev, which was granted by a judge on September 30. Chigvintsev filed his own request for a protective order on October 3, which was similarly granted the following day.

The legal battle has placed a spotlight on their once seemingly perfect relationship, with each party accusing the other of lying and manipulating the situation. Garcia’s representatives have emphasized her priority of protecting her son, while Chigvintsev’s lawyer, Ilona Antonyan, has pointed to the impact these accusations have had on his career, noting that several professional opportunities have been canceled as a result.

Despite the Napa County District Attorney’s decision not to file criminal charges against Chigvintsev, the legal drama continues to unfold. Both parties are expected to present their cases in court later this month, with the future of their co-parenting relationship—and their personal and professional reputations—hanging in the balance.

As they prepare for the upcoming hearing, Chigvintsev and Garcia remain at odds, each adamant that the other was the aggressor during that fateful morning. With conflicting accounts and ongoing legal proceedings, the once beloved couple’s personal turmoil has now become a very public battle for the truth.
